No Charges Planned in Alleged Coach Kickbacks

The Capistrano Unified coaches implicated and fired in connection with an alleged kickback scheme involving a sports equipment company won't face charges, the District Attorney says.

A spokeswoman for the district attorney's office said this week the Capistrano Unified coaches implicated in an alleged kickback scheme with a sports equipment company won't face criminal charges, the Orange County Register reports:

"Based on the evidence submitted to us, we did not feel there was sufficient evidence to prove a criminal case," D.A. spokeswoman Farrah Emami said. "We need to be able to prove beyond a reasonable doubt that a crime occurred."

Capistrano coaches and teachers Charles "Chi Chi" Biehn, Brent Melbon and Eric Patton were terminated after the school district accused them of stealing tens of thousands of dollars of taxpayer money.

Four other coaches and teachers – Ken Goldstone, Jeff Veeder, Joe Wood and Ken Workman – were formally reprimanded after being put on leave from their coaching duties.

CUSD , Farley and the BOARD recklessly and irresponsibly RUINED the life, career and reputation of DR. PATTON. Following the incompetent lead of Dr Farley and their biased internal investigation, they ignored evidence, refused to interview witnesses and failed to substantiate their exaggerated allegations. Their report was laden with unverified statements, false assumptions, speculation, and misrepresentations. After 18 months of grandstanding CUSD hurriedly took punitive action just BEFORE the sheriffs report exonerated him of criminal intent and personal gain.THIS BOARD and FARLEY should be removed and held fiscally responsible for their irreparable harm.

I'm glad to see the District Attorney is not pursuing charges. The coaches are good guys that have done a lot of positive work on behalf of the students, athletes and the district.

So we have a distict awash in red ink & the board allows this pinhead Farley to waste all the resources that went into this witchunt. Eric's been exonerated. I think the voters in CUSD need to keep this incident in mind when voting in November.

Matt How many of your friends and neighbors voted for the union backed trustees, in particular, Alpay and Pritchard, who are for all intents and purposes running the board. Sorry to say, the parents and families in CUSD got what they voted for. Hopefully, they will vote in new trustees who will actually have CUSD's best interests at heart

I wonder if Mr. Lopez would have saluted Farley and gone along with this farce had he been on the board at the unfair and possible illegal board meeting where the Trustees voted to begin the termination process against the coaches. Only Sando was notified that the hearing was going to culminate in a vote, the coaches were not told they could attend the meeting (proper notice was not provided).....I certainly hope those trustees up for reelection are terminated (and we should look into seeking restitution). VOTE them all out, especially ALPAY and PRITCHARD! And let's stop Farley's reign of terror.
