UPDATED: Slaying Victim 'Nearly Decapitated'

Arraignment postponed for accused killer. Meanwhile, new details emerge in last week's mobile-home park killing.

The knife-wielding neighbor accused of killing Bobby Ray Rainwater won't enter a plea until Jan. 6.

At the request of Robert Eugene Vasquez's attorney, his Tuesday arraignment was postponed until after the new year, said D.A. spokeswoman Farrah Emami.   

Vasquez is accused of punching Rainwater in the back of the head and then stabbing him so many times that Rainwater was nearly decapitated.

The grisly new details were laid out by prosecutors Monday evening.

Vasquez, 34, has been charged with special circumstances murder for allegedly lying in wait for Rainwater, a 54-year-old registered sex offender who was found dead in front of his San Juan Capistrano mobile home last week.

Vasquez was also charged with aggravated assault in a separate attack two days later.

According to prosecutors, Vasquez waited outside Rainwater's San Juan Hills Mobile Estates home on Alipaz Street early Thursday with the intention of killing him.

Vasquez first punched Rainwater in the back of the head, then stabbed him multiple times, “nearly decapitating him,” according to a district attorney press release. He then fled the scene.

If convicted, Vasquez faces a life sentence without the possibility of parole, according to the D.A.’s office. The addition of the special circumstances charge means he is also eligible for the death penalty.

Orange County Sheriff’s deputies originally arrested Vasquez for his alleged involvement in a second assault on Saturday, this one at another home in San Juan Capistrano. The D.A.’s office said Vasquez allegedly used a metal bar to hit Lance Lyons in the face while he was lying down. Lyons' brother intervened to stop the attack from continuing, authorities said.

In the course of investigating that case, deputies connected Vasquez to the Rainwater slaying, the press release said.

Investigators have not revealed possible motives for either attack.

Robert Vasquez is an evil, violent & disturbed man. He attacked my peaceful neighbors in the Santa Cruz mountains, smashed their windows & threatened to kill them. They were so afraid they packed up their dog & possessions & moved away... but then their bus broke down with this madman chasing them. Luckily someone called the police & I happened to be driving by so I stopped to help (turns out they just needed gas). The nice police safely got them out of town. Too bad they didn't escort this murder to prison. (BTW, sadly our sex offender list includes all kinds of offenses, not just child molesters & rapists. I.E. If you have been dating your high school sweetheart & you turn 18 but she is still 17 you can be convicted for stachatory (sp?) rape & will then have to register as a sex offender for the rest of your life. There are even less offenses included).

As one of more than 60,000 registered sex offenders in the state of California, I can only shudder to think of the weakness and darkness that mankind can show to itself, and in this case, the death of a criminal or a victim of circumstance, the guilt of which is not only on the hands of a young deranged man by the name of Robert Eugene Vasquez, but I believe is on the hands of our society that is so easily misled by rating seeking media and political charlatans. The public demands to punish over 60,000 people for the sins of a few, highly publicized, albeit tragic and horrific incidents, and is prevented from the mob style, lynching by the rule of law, the Bill of Rights and the Constitution, which they curse as an obstacle to "true" justice. Wake up, my fellow Mayberrians. The world is not as simple as making up an arbitrary list of exterminatable humans... My sins, I have paid long and deeply for, have you paid for yours, in equal measure?

I can't belive he is gone. He was such a quite boy. It sadens my heart to know that I will never see this young an again. I loved im very much. I loved his brothers, His Mom and Dad. He was my oldest nephew. I will forever miss him and love him very deepley. I do not understand how this can happen I hope the person that did this gets what he deserves.

Patsy, we are following this story. Mr Vasquez's case has yet to go to trial.

this is my ex husband and my high school sweetheart. we were friends for 10 years before we got married and were married for 3 years before we decided it wasnt to be. he was always a good man but suffered from a terrible addiction to drugs. please pray for him and for the families of the people he hurt. including mine.
